Even a properly repaired accident vehicle is worth less on the market than an accident-free vehicle of the same type and age — purely because it once had an accident. This merkantiler Minderwert (Wertminderung, diminished value) is a separate head of damage alongside the repair cost. A rigid age or mileage limit that would rule it out has not existed since 2004. It is estimated by an expert case by case, not by a prescribed formula. Where calculated from gross prices, the Bundesgerichtshof deducts the VAT share.

Merkantiler Minderwert: A Claim Despite a Fully Repaired Car

Merkantiler Minderwert (the loss in market value a repaired vehicle retains despite a technically flawless repair) is the amount your car is worth less by, purely because it once had an accident.

A buyer generally pays less for a vehicle with a known accident history, even where the repair was carried out to a technically flawless standard — the mere duty to disclose it on resale pushes the price down. The party at fault reimburses this Minderwert (diminished value) as a separate head of damage alongside the repair cost. It arises with the accident itself and is therefore awarded even under a notional settlement, without having the car repaired; the position can differ if you sell the vehicle unrepaired — courts then treat the Minderwert as already priced into the resale value (Restwert) achieved.

Comprehensive cover (Kaskoversicherung): under many comprehensive-cover terms (AKB), merkantiler Minderwert is expressly excluded or only partly reimbursed. This affects only claims under your own comprehensive policy, not the claim against the other driver's liability insurer described here.

This reflects German law and German court practice.

Do I get Wertminderung even though my car is fully repaired?

Yes.

Do I get Wertminderung under a notional settlement too?

Yes, according to the prevailing case law. The claim does not depend on whether you actually have the car repaired. The Minderwert arises as soon as the accident happens, because from that moment the vehicle is an Unfallwagen (accident-damaged vehicle). The Bundesgerichtshof detached the claim from what becomes of the vehicle as early as 1961: it is reimbursed even to an owner who simply keeps driving it (BGH, judgment of 03.10.1961, VI ZR 238/60). Lower courts draw the consequence for a notional settlement (fiktive Abrechnung) from this: you are under no duty to repair, the claim falls due immediately, and it exists even under an abstract, i.e. notional, settlement (LG Memmingen, judgment of 08.01.2019, 33 O 1276/17).

What counts is the value your vehicle would still have after a proper repair. So the repair must be technically possible, not actually carried out. How you settle the claim does not affect the amount: the Minderwert is estimated from net sale prices regardless, whether or not you submit an invoice.

The opposing position: if you sell the vehicle on unrepaired, courts treat the Minderwert as already priced into the resale value (Restwert) achieved — a buyer of an unrepaired accident vehicle factors it into the price. An additional Wertminderung is then not awarded (LG Duisburg, judgment of 17.04.2014, 12 S 153/13). The same applies to a total loss (Totalschaden): where you settle based on the Wiederbeschaffungswert (replacement value) minus the Restwert, the Minderwert is already contained in that difference and is not paid again.

At what vehicle age does Wertminderung stop applying?

A rigid limit has not existed since 2004: the used-car market has changed, and valuation bodies now cover vehicles up to twelve years old. Even a well-maintained twelve-year-old vehicle can still suffer a diminished value in an individual case. There is no calculation method prescribed by case law — the amount is estimated by an expert case by case.

Honesty requires saying: the case law is not a one-way street. The Bundesgerichtshof (BGH) deducts the VAT share from the Minderwert where it was determined from gross prices — that works against the injured party. And even the 2004 landmark decision that abolished rigid age limits ended, in the specific case, with the diminished value being denied.

Repaired front-end damage, vehicle six years old
ItemAmount
Repair cost per invoice, net6,200.00 €
Wiederbeschaffungswert per report18,500.00 €
Merkantiler Minderwert per report650.00 €
Insurer's payment (Wertminderung struck)6,200.00 €

Result: 650.00 € shortfall. The insurer struck the Wertminderung entirely, citing the vehicle's age. Since a rigid age limit has not existed since 2004, such a blanket cut can be challenged — what counts is the expert's case-by-case estimate, not age alone.

What the insurer typically writes

These are paraphrased summaries of typical settlement-letter reasoning, not verbatim quotes from one specific letter.

„Ihr Fahrzeug ist zu alt bzw. hat eine zu hohe Laufleistung. Eine Wertminderung wird bei Fahrzeugen dieses Alters nicht mehr anerkannt.“ (English: "Your vehicle is too old or has too high a mileage. A diminished-value claim is no longer recognised for vehicles of this age.")
„Die angesetzte Wertminderung ist nicht nachvollziehbar begründet und wird gestrichen.“ (English: "The Wertminderung claimed is not comprehensibly justified and is being struck.")
„Der merkantile Minderwert wurde aus Bruttopreisen ermittelt. Wir kürzen ihn um den Umsatzsteueranteil.“ (English: "The merkantiler Minderwert was calculated from gross prices. We are deducting the VAT share from it.")
„Bei einem wirtschaftlichen Totalschaden entfällt der Anspruch auf Wertminderung.“ (English: "Where there is an economic total loss, the claim for Wertminderung does not apply.")

How you can respond

English translation (for your understanding only — send the German text above, not this one):

Dear Sir or Madam,

you have struck the merkantiler Minderwert of … euros stated under item … of the report of …, citing my vehicle's age. A rigid age or mileage limit for excluding Wertminderung has not existed since the Bundesgerichtshof's 2004 decision (BGH, judgment of 23 November 2004, VI ZR 357/03). Even an older vehicle can still suffer a diminished value where it has been well maintained. The amount was estimated by my expert on a case-by-case basis. I therefore maintain the item and ask for payment by … .

What the insurer typically does next

  1. It pays the balance. Often when the report justifies the Wertminderung on a case-by-case basis, for example by maintenance history, prior ownership and market conditions.
  2. It disputes the estimation method. An insurer cannot justify a cut merely by claiming the expert used "the wrong formula" — there is no prescribed calculation method.
  3. It deducts the VAT share. That is permitted where the Wertminderung was determined from gross prices; net sale prices are what matters.
  4. It sticks to the deduction. Usually a three-figure amount, often pursued together with other deducted items.

Important for a total loss: for the 130-percent limit (130-Prozent-Regel), the Wertminderung is added to the repair cost. Whether an additional "new-for-old" deduction may shift this limit to the injured party's detriment is not answered uniformly in case law — most published decisions do not treat such a deduction as reducing the damage for the 130-percent calculation. Details on the 130-percent rule are on our page on Totalschaden and Restwert.

On the deadline: a liability insurer (Haftpflichtversicherer) is usually allowed a review period of four to six weeks from submission of the complete documents. Set a specific payment deadline in your letter. If the insurer does not respond, it falls into default (Verzug, § 286 BGB) and owes default interest from that point. Claims from a road accident generally become time-barred after three years, counted to the end of the year (§ 195, § 199 BGB).

Where this is in the report: the merkantiler Minderwert usually appears as its own line near the Wiederbeschaffungswert, often under the heading "Wertminderung" or "Minderwert", stating the estimation basis the expert applied. If this justification is missing or too brief, ask for a supplementary statement from your expert.

This reflects German law and German court practice.

Frequently asked questions

Do I get Wertminderung even though my car is fully repaired?

Yes. Merkantiler Minderwert is a separate head of damage alongside the repair cost — it arises precisely because there was an accident, regardless of repair quality.

How is Wertminderung calculated?

There is no prescribed formula. The Minderwert is estimated by an expert case-by-case under § 287 ZPO; tabular methods like Ruhkopf/Sahm are aids, not a substitute for the case-by-case estimate.

At what vehicle age does Wertminderung stop applying?

A rigid limit has not existed since 2004. Even well-maintained twelve-year-old vehicles can still suffer a diminished value in an individual case.

Do I get Wertminderung under a notional settlement too?

Yes. The Minderwert arises with the accident, not the repair, and is also awarded under a notional settlement. The position can differ if you sell the vehicle unrepaired — then it is usually already reflected in the Restwert.

Why does the insurer deduct VAT from the Wertminderung?

Where the Minderwert was determined from gross prices, the Bundesgerichtshof requires the VAT share to be deducted. Net sale prices are what matters (BGH VI ZR 205/23).

Is Ruhkopf/Sahm the correct calculation method?

No. The method is common in practice but does not take precedence over the case-by-case expert estimate — it is subordinate to it.
